In this Privacy Notice, we, Sauce Labs Inc., describe our collection, use and disclosure of personal information received via the following channels:
Any websites, products, services and software that we operate and in which we post a direct link to this Privacy Notice (collectively, our “Services”); and
Face-to-face, phone, email, mail or other business interactions with individual representatives of our customers, vendors or other businesses interested in our products and services.
This Privacy Notice does not apply to data that is uploaded to customer accounts in our Services (including accounts supplied through free trial offerings) for processing in the course of testing websites or native mobile applications, including any data contained in the websites or native mobile applications being tested, test commands and input data, output data, test logs, screen shots, videos, reports and analytics furnished by our Services. We refer to this data as “Test Data” and our processing of Test Data is governed by the terms of our agreements with our account holders.

If you access or use our Services or otherwise actively provide us with your personal information, you agree that we may collect, use and process your personal information as outlined in this Privacy Notice and as permitted by applicable laws. If you do not agree to the terms of this Privacy Notice, please do not use our Services or provide us with any personal information.
Information You Actively Submit: If you create an account with us, register for a free trial, order our Services, or contact or correspond with us for business purposes, we collect personal information about you and the company or other entity you represent, including the following:
Contact Data, which includes your name, title, username, organization, address, email address, phone number and fax number;
Account Data, which includes your Contact Data and the details of the Services you have ordered or purchased from us and any billing address and payment card details you provide to us; and
Correspondence Data, which includes your requests, comments, interests and any other information you actively provide to us.
Information Passively Submitted on our Services: When you use our Services, we collect information from or about the computer, phone or other device on which you have installed or from which you access our Services, and information about your usage of our Services, including the following:
Technical Data: The Internet protocol (IP) address used to connect your device to the Internet; browser type, version, and time zone setting, browser plug-in types and versions, operating system, and platform; the phone number you used to call us if you call us.
Usage Data: The full Uniform Resource Locator (URL) clickstream to, through, and from our Services, including date and time; cookie number; Services you viewed; your searches on our Services; session information, including page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page.

To process any transactions you make on our Services;
To prevent fraud;
To gather statistical information about usage of our Services;
To enable interactive features in our Services;
To advertise our Services on third party websites and other digital media.
Publicly Available Information: If you have identified yourself to us as a user of our Services or expressed interest in our products or services, we may collect the following personal information about you from publicly available sources: your organization, contact information, preferences and demographic information. These publicly available sources include public profiles on company and professional networking websites.
We offer our websites, products and Services to business customers. Our Services are not intended or suited for consumers or children.
We use the following categories of personal information for the following purposes:
Contact Data to communicate with you in relation to your account.
Account Data to: (i) create an account for you or the organization for which you work; (ii) manage the account; (iii) fulfill your orders for products and services; and (iv) provide you with customer service and technical assistance.
Correspondence Data to respond to any specific comments or questions you may have.
Technical Data and Usage Data to: (i) provide, maintain, monitor, secure, debug, customize and optimize our Services; (ii) provide you with customer service and technical assistance; and (iii) develop and improve our products and services.
Publicly Available Information to supplement the other personal information we hold about you in support of our sales and marketing activities.
We also use your personal information for the following purposes, as permitted by applicable law:
Performance of Contracts: To perform our obligations and exercise our rights under our Terms of Service or any other agreement relating to our Services that you conclude with us.
Compliance with Laws: To perform activities necessary to ensure compliance with applicable national, state, provincial and other applicable laws, and to respond to requests from government authorities.
Protection of Legal Interests: To protect the legal interests, health or safety of a user, us, or other third parties, such as in the event of a complaint or dispute, or to perform credit recovery procedures or credit assignments to authorized third parties.
Marketing Activities: As permitted by applicable law, including with your consent where required, we may use your contact information to provide you with marketing communications, promotional offers and updates on new products and services.
Special Events: If you register for and attend Sauce Labs events, such as SauceCon, Sauce Labs will process your personal information for the purposes of administering, securing, optimizing, and running the event, as well as improving on future events.
Merger or Sale: In the event that we, or some or all assets related to our Services are acquired by or merged with a third-party entity or in connection with a merger, acquisition, sale, or other change of control, we may transfer some or all of the personal information that we have collected about you to another organization as part of that transaction. If we intend to transfer your personal information in connection with such a transaction, we may proceed with notice to you, grant you an opportunity to object, or seek your consent, as permitted or required by applicable law.
Information about our customers is an important part of our business, and we are not in the business of selling it to others. We share your personal information only as described below and in accordance with applicable law.
Service Providers: We employ our affiliated and other unaffiliated companies and individuals to perform functions on our behalf, such as to send email, remove repetitive information from customer lists, analyze data, provide marketing assistance, provide search results and links (including paid listings and links), process credit card payments, and provide customer service. They have access to personal information needed to perform their functions, but may not use it for other purposes.
Affiliates: We share your personal information with our affiliates to help fulfil sales, respond appropriately to requests and to improve our and their services and business practices. A list of our operating affiliates and their addresses is available here.
Event Sponsors: Sauce Labs works with various sponsors to hold special events such as SauceCon. If you consent and direct us to do so, we will share your personal information with these sponsors for purposes we will disclose before you provide your consent.
Merger or Sale: As we continue to develop our business, we might sell or buy subsidiaries, business units or our entire business. In such transactions, customer information generally is one of the transferred business assets but remains subject to the promises made in any pre-existing Privacy Notice (unless the customer consents otherwise) and applicable laws.
Protection of Sauce Labs and Others: We disclose account and other personal information when we believe it is appropriate to comply with the law; enforce or apply our Terms of Service and other agreements; or protect the rights, property, or safety of Sauce Labs, our users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction. This does not include selling, renting, sharing, or otherwise disclosing personally identifiable information from customers for commercial purposes in violation of the commitments set forth in this Privacy Notice.
With Your Consent: Other than as set out above, we will obtain your consent as required by law before disclosing your personal information to a third party.
We maintain measures intended to protect your personal information from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. For example, we use Secure Sockets Layer (SSL) software, which encrypts information you input, to protect information you submit via our Services.
We reveal only the last four digits of your credit card numbers when confirming an order. Of course, we transmit the entire credit card number to the appropriate credit card company during order processing.
It is important for you to protect against unauthorized access to your password and to your computer. Be sure to sign off when finished using a shared computer.
Sauce Labs does not display third-party advertisements on its Services at this time.
We may provide links to other third-party websites and services that are outside our control and not covered by this Privacy Notice. We encourage you to learn about the privacy practices of those third parties.
If you have an account on our Services, please note that our Services give you access to a broad range of information about your account and your interactions with our Services for the limited purpose of viewing and, in certain cases, updating that information.
Under applicable laws, you may have rights to access, update, rectify, port or erase certain personal information that we have about you or restrict or object to certain activities in which we engage with respect to your personal information. To submit a request to exercise any such rights, please visit our privacy request webform and clearly describe your request. If you have such rights and your request complies with the requirements under applicable laws, we will give effect to your rights as required by law.

You can choose not to provide personal information to us. However, some features of our Services, such as your account profile, require that we collect some personal information about you.
If you do not want to receive marketing emails from us, please adjust your email preference settings by clicking here or click on the “opt-out” link in the communication. Even after you have opted out of receiving marketing emails from us, we may still contact you for transactional or informational purposes. These include, for example, customer service issues or any questions regarding a specific inquiry you made to us.
Privacy Shield Disclosures
We comply with the EU-U.S. Privacy Shield Framework with respect to personal data of residents of the European Economic Area (“EEA”) that we receive from EEA residents who use our websites and online services (“EEA Residents”) and companies in the EEA. We registered for the Privacy Shield list maintained by the U.S. Department of Commerce at https://www.privacyshield.gov/list. These Privacy Shield Disclosures do not apply to data that we collect from employees of our subsidiaries in the EEA or to data that we collect from other jurisdictions; we cover such data in other, separate notices as required.
You may view the types of personal data we collect, the purposes for which we collect, use and disclose personal data, the types of third parties to whom we disclose personal data, and the choices and means available to you to limit our use and disclosure of personal data under the sections above entitled “What Types of Personal Information Do We Collect?”, “How Do We Use Your Personal Information?”, “To Whom Do We Disclose Your Personal Information?” and “Your Choices”.
Commitment to subject to the Principles: We subject to the applicable Privacy Shield Principles all personal data that we receive from companies or individuals in the EEA in reliance on the Privacy Shield. We also receive some personal data in reliance on other compliance mechanisms, including data processing agreements based on the EU Standard Contractual Clauses.

Right of Access: EEA Residents have the right to access the personal data we have about them on file. To exercise this right, please contact email@example.com.
Independent Dispute Resolution Body: We commit to resolve complaints about our collection or use of EEA Residents’ personal data and provide appropriate recourse at no cost to them. We have further committed to refer unresolved Privacy Shield complaints to JAMS, an alternative dispute resolution provider located in the United States. If an EEA Resident does not receive timely acknowledgement of their complaint from us, or if we have not addressed the complaint to the EEA Resident’s satisfaction, the EEA Resident may visit: https://www.jamsadr.com/eu-us-privacy-shield for more information or to file a complaint. The services of JAMS are provided at no cost to EEA Residents. Sauce Labs is subject to investigation and enforcement powers of the U.S. Federal Trade Commission.
Arbitration: If EEA Residents have exhausted all other means to resolve their concerns regarding a potential violation of our obligations under the Privacy Shield Principles, they may seek resolution via binding arbitration. For additional information about the arbitration process please visit the Privacy Shield website: www.privacyshield.gov.
Requirement to Disclose: We may be required to disclose personal information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.
Liability for Onward Transfers: If a third-party service provider providing services to us processes an EEA Resident’s personal data in a manner inconsistent with the applicable Privacy Shield Principles, we will be liable unless we can prove that we are not responsible for the event giving rise to the damages.
Our business changes constantly, and our Privacy Notice will also change. If we change, modify, add or remove portions of this Privacy Notice, we will provide you with notice of such updates as required by applicable law and upload the updated Privacy Notice to our website saucelabs.com. You should check our website regularly to see any recent changes we may have made.
Unless stated otherwise, our current Privacy Notice applies to all information that we have about you and your account. We stand behind the promises we make and will never materially change our policies and practices to make them less protective of customer information collected in the past without the consent of affected customers.
